Terms of Use of the site

This contract has been drawn up and is dated as indicated. It binds EKSCARS, hereafter referred to as “the lessor,” and the individual, company, or organization signing this contract, hereafter referred to as “the lessee.”

Vehicle usage

I agree that the vehicle will not be used for the following purposes:

1. For the paid transport of passengers, whether the compensation is explicitly or implicitly agreed upon.
2. For the transport of contraband goods leading to the immobilization or seizure of the vehicle by authorities. In such a case, I agree to pay EKSCARS the value of the vehicle according to the current year’s market price, plus an additional indemnity of 20,000.00 DHS and all legal fees incurred by EKSCARS in the event of legal proceedings.
3. To push or tow any other vehicle or trailer.
4. As part of any automotive sporting competitions.
5. By any person under the influence of alcohol or narcotics.
6. Furthermore, the vehicle can only be driven by the individuals designated in this contract, subject to prior authorization from EKSCARS. Additionally, these individuals must be at least 21 years old and hold a valid driving license for at least one year.

Vehicle Condition

The vehicle is delivered in perfect working condition and cleanliness. The odometers and their connections are sealed, and these seals must not be removed or tampered with, under penalty of paying for the rental based on 100 km per day. The vehicle must be returned in the same clean condition; otherwise, the renter must cover the costs of cleaning and restoring the vehicle. All five tires are in good condition with no cuts and normal wear. The renter agrees to replace any tire immediately with one of the same size and similar wear or to pay the equivalent cost.

Maintenance and Repairs

Normal mechanical wear is the responsibility of the rental company. All repairs due to either normal wear, negligence by the renter, or accidental causes will be at the renter’s expense and carried out by our team. If the vehicle is immobilized outside the region, repairs due to either normal wear or accidental causes will only be performed after telegraphic approval from the rental company or by the regional agent of the vehicle’s brand. These repairs must be supported by a fully itemized and paid invoice. Any replaced defective parts must be presented with the paid invoice.

The renter cannot claim damages for delays in the return of the vehicle or cancellation of the rental. The responsibility of the rental company can never be invoked, even in the event of accidents involving persons or property resulting from construction defects or previous repairs. In the event of an accident caused by the renter’s fault, the costs of the damages to the vehicle and any additional charges will be entirely at the renter’s expense.

Deposit and Rental Extension

The rental amount is payable in advance. The deposit is a prerequisite from EKSCARS. In the event that an extension is granted, I commit to sending the additional rental amount 48 hours before the current rental period expires. I agree not to contest the payment from the deposit or guarantee provided if it covers:

• Unexplained damages.
• Loss of documents.
• Towing fees or other related charges, provided that our company supplies the necessary supporting documents.

Vehicle Documents

At the end of the rental period and upon returning the vehicle, the renter must return the registration card and all necessary documents required for the vehicle’s operation. If these documents are not returned, as they are essential for future rentals, the rental will continue to be charged at the original rate until they are handed over to the company. In the event of loss of these documents, the renter will be responsible for covering the cost of obtaining duplicates.

Liability and Jurisdiction

The renter remains solely responsible for any fines, penalties, or citations issued against them. Only the designated jurisdiction shall be competent in such matters.

Insurance

At the end of the rental period and upon the return of the vehicle, the renter must hand over the registration card and all necessary documents required for the vehicle’s operation. Failure to do so will result in continued rental charges at the initial rate until these documents are returned to the company. In case of loss of these documents, the renter will be responsible for covering the costs of obtaining duplicates.
