This contract, hereby effective as indicated, establishes the agreement between www.ekscars.com, henceforth referred to as the lessor, and the individual, company, or corporation signing this contract, henceforth referred to as “the lessee”.

ARTICLE 1 – VEHICLE USAGE GUIDELINES

www.ekscars.com ensures that the vehicle shall not be utilized for the following purposes:

  1. For transporting passengers in exchange for payment, regardless of whether the compensation has been implicitly or explicitly agreed upon.
  2. For the conveyance of contraband goods resulting in the confiscation or immobilization of the vehicle by the authorities. In such a case, the lessee agrees to compensate www.ekscars.com with the vehicle’s current market value, as per the yearly price list, along with an additional indemnity of 20,000.00 MAD. Additionally, the lessee is liable for covering all costs incurred by www.ekscars.com in the event of legal proceedings.
  3. For propelling or towing any other vehicle or wagon.
  4. Engaging in automobile competitions.
  5. By any individual under the influence of alcohol or drugs.
  6. Furthermore, the vehicle may only be operated by individuals designated in the present contract, subject to prior authorization from www.ekscars.com. Designated individuals must be at least 21 years old and possess a valid driver’s license for a minimum of one year.

ARTICLE 2 – VEHICLE CONDITION

The vehicle is provided in excellent operational condition and cleanliness. The odometers and their connections are sealed; these seals must not be tampered with or removed. Any violation of these seals will result in the lessee being charged based on a daily rental rate of 100 km. Upon return, the vehicle is expected to be in the same clean condition. Failure to comply will incur charges for cleaning and restoration. All five tires are in optimal condition without any cuts. In the event of normal wear, the lessee agrees to promptly replace the tire with one of the same size and comparable wear or to compensate accordingly.

ARTICLE 3 – MAINTENANCE AND REPAIRS

www.ekscars.com bears responsibility for normal mechanical wear and tear. All repairs arising from normal wear and tear, negligence on the lessee’s part, or accidental causes will be covered by the lessor and conducted by us. If the vehicle becomes immobilized outside the designated region, repairs—whether due to normal wear and tear or accidental causes—will only proceed after obtaining telegraphic approval from the lessor or the regional agent of the vehicle’s manufacturer. These repairs must be accompanied by a detailed and paid invoice. Any defective parts replaced must be presented alongside the paid invoice.

The lessee relinquishes any claims for damages or interests due to delays in vehicle handover or rental cancellation. The lessor cannot be held liable, even in the event of accidents involving persons or property, which may have resulted from defects in construction or previous repairs. In the event of an accident caused by the lessee’s fault, all expenses incurred for damages to the vehicle and associated surcharges will be entirely borne by the lessee.

ARTICLE 4 – SECURITY DEPOSIT / RENEWAL

The rental fee is to be settled in advance. The security deposit is to be provided to www.ekscars.com prior to commencement of the rental period. Should I opt for renewal, I agree to remit the additional rental amount 48 hours prior to the conclusion of the current rental period. I acknowledge that I shall not contest payment via the security deposit or guarantee furnished if said deposit covers:

  • Unjustified damages.
  • Loss of documents.
  • Impoundment charges or other relevant expenses, provided that our company furnishes the requisite supporting documentation.

ARTICLE 5 – VEHICLE DOCUMENTATION

Upon conclusion of the rental period and upon returning the vehicle, the lessee is required to surrender the vehicle registration document and all pertinent documents necessary for its operation. Failure to do so will result in the continuation of rental charges at the initial rate until these documents are provided to the company, as they are essential for subsequent rentals. In the event of document loss, the lessee is responsible for covering the expenses associated with obtaining duplicates.

ARTICLE 6 – RESPONSIBILITY AND AUTHORITY

The lessee retains full responsibility for any fines, violations, or reports issued against them. Only competent authorities are authorized to handle such matters.

ARTICLE 7 – INSURANCE

The lessee acknowledges that it is their responsibility to ensure that the vehicle is adequately insured for the duration of the rental period. Any damages incurred during the rental period shall be covered by the lessee’s insurance policy, subject to the terms and conditions outlined therein.
